E4C3 Technology, LLC (“Provider,” “we,” “us,” or “our”) provides this Privacy Notice (“Notice”) to inform you of our guidelines for the collection, processing, retention, use, maintenance, and disclosure of personal data collected through the platform (available at www.myplaygrounds.ai (the “Playgrounds Platform”) and to the software enabled information, content, data, interfaces, tools, platforms, playgrounds, development tools, modules, and apps accessible on, from, or through the Playgrounds Platform (collectively, the “Playgrounds Applications”).

This Notice applies to information we collect through the Playgrounds Applications from you, including, for example only, information you provide or we collect when you create an account, access the Playgrounds Applications, use the Playgrounds Applications, use any artificial intelligence features of the Playgrounds Applications, store data on the Playgrounds Platform using the Playgrounds Applications, or link the Playgrounds Applications to data sources or information. This Notice does not apply to information collected by us offline or through any other means.

Please read this Notice carefully. This Notice describes how we handle the information we collect when you interact with the Playgrounds Applications or provide information to us. We may update this Notice from time to time, and the “Last Updated” date above will reflect the most recent revision. Please check the Notice periodically for updates.

1. Children’s And Minors’ Data

The Playgrounds Applications are not intended for, and we do not knowingly collect any personal data from, children under the age of 18. If we learn we have collected or received personal data from a child under 18 years old without verification of parental consent, we will delete that information.

2. What Personal Data Do We Collect?

“Personal data” is information that is linked or reasonably linkable to you as an identified or identifiable individual, or to a household or device associated with you, to the extent required by applicable law, such as your name, email address, and telephone number. You are an identified or identifiable individual when you can be identified directly or indirectly. Personal data does not include data that cannot be attributed to a specific individual without the use of additional information, provided the additional information is kept separately and is subject to appropriate technical and organizational measures to ensure that the data is not attributed to an identified or identifiable individual. Personal data also does not include deidentified data or publicly available information.

The types and categories of personal data we collect or process include the following, to the extent any of the following can be used to identify you directly or indirectly as an individual:

  • Contact information you provide to us, including your name, email address, mailing address, and phone;
  • Geographic information, including the city, state, and zip code where you reside;
  • Content and information you elect to provide as part of using or accessing the Playgrounds Applications;
  • Device information, including your IP address, device identifiers, operating system and version, preferred language, hardware identifiers, browser type and settings, and other device information;
  • Location information, including general geographic location such as country, state or province, or city, if you have enabled and consented to location information; and
  • Information you provide to, or that is generated by, the artificial intelligence features of the Playgrounds Applications, including prompts, inputs, queries, AI Outputs (as defined in the Terms and Conditions of Use), and your interaction history with AI features.

Some of the above types and categories of information may be non-personal data.

We do not intentionally collect sensitive personal data (such as Social Security numbers, financial account numbers, precise geolocation, biometric data, health information, or data revealing racial or ethnic origin, religious beliefs, or sexual orientation). If you provide sensitive personal data to us through the Playgrounds Applications, you do so at your own risk, and we will treat such data in accordance with this Notice and applicable law.

We also collect the following non-personal data:

  • Statistics or aggregated information. We may also derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific feature of the Playgrounds Applications. Statistical or aggregated data is not linked to you as an individual.
  • Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Playgrounds Applications, such as clickstream information to, through, and from our Playgrounds Applications (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.

If we combine or connect non-personal statistical, aggregated, or technical data with personal data so that it is linked or reasonably linkable to you, we will treat the combined information as personal information.

3. How We Collect Your Personal and Other Data

You Provide Information to Us

We collect information about you when you provide it to us, for example, by inputting your information into the Playgrounds Applications when you create an account or otherwise use or access the Playgrounds Applications.

Automatically Through The Playgrounds Applications

As you navigate through and interact with the Playgrounds Applications, we also may use automatic data collection technologies to collect information that may include personal data. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies or using JavaScript, including details of your interactions with the Playgrounds Applications, such as traffic data, location data, logs, and other communication data, and which resources and features of the Playgrounds Applications that you access and use.

Using automatic collection technologies helps us to improve the Playgrounds Applications and to deliver a better and more personalized experience.

The technologies we use for this automatic data collection may include:

  • Cookies. A cookie is a small file placed on your device when you interact with each of the Playgrounds Applications. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Playgrounds Applications.
  • JavaScript. The Playgrounds Applications may use JavaScript to collect information about your interaction with the Playgrounds Applications. When you visit a page, the JavaScript tracking code executes and records information such as the pages you view, the time and duration of your visit, the links and buttons you click, your approximate geographic location, your device type and browser type, and the website or source that referred you to the Playgrounds Applications.

To the extent any of these automated technologies are considered a personal data sale, targeted advertising, or profiling, under applicable laws, depending on where you live, you may opt out from use of these automated technologies for such uses by adjusting your “Cookies Preferences” when you first visit each of the Playgrounds Applications or by sending a request to opt out using our contact information below. Please note that some features of the Playgrounds Applications may be unavailable as a result.

When you interact with the Playgrounds Applications, there are third parties that may use automatic collection technologies to collect information about your or your device. These third parties may include:

  • Analytics companies.

These third parties may use tracking technologies to collect information about you when you use the Playgrounds Applications. The information they collect may be associated with your personal data or they may collect information, including personal data, about your online activities over time and across different Playgrounds Applications, apps, and platforms.

4. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal data, to:

  • Provide you with the Playgrounds Applications and any contents, features, or information that we make available through the Playgrounds Applications;
  • Fulfill any other purpose for which you provide it;
  • Improve the Playgrounds Applications, including by analyzing your information and creating aggregated data derived from your information to develop, maintain, analyze, improve, optimize, measure, and report on the Playgrounds Applications and their features and how users interact with them;
  • To create new software, products, or services for you or others;
  • To train, develop, test, and improve AI models, including without limitation, models used for the Playgrounds Platform and models used to create new products or services;
  • To create data and information derived from, based on, or related to your use of the Playgrounds Applications;
  • To analyze traffic;
  • In any other way we may describe when you provide the information;
  • In the case of information that has been deidentified, to create promotional or marketing materials;
  • To establish, exercise, or defend legal claims; or
  • For any other purpose with your consent.

Our legal basis for processing your personal data depends on the context in which it is collected and used, and may include: (a) performance of a contract with you (including the Terms and Conditions of Use and any applicable SaaS Agreement); (b) your consent, where you have provided it; (c) our legitimate business interests, such as improving the Playgrounds Applications, preventing fraud, and ensuring security; or (d) compliance with a legal obligation.

In addition, the usage information we collect, whether connected to your personal data or not, helps us improve the Playgrounds Applications and deliver a better and more personalized experience by enabling us to:

  • Estimate our audience sizes and usage patterns; or
  • Recognize you when you return to the Playgrounds Applications.

We may also use your information to contact you about goods and services that may be of interest to you. If you do not want us to use your information in this way, please contact us through the contact information below. For more information, see Your Rights and Choices About Your Information (below).

5. Who We Disclose Your Information To

We may disclose deidentified information that does not identify any individual without restriction. Deidentified information is information that cannot reasonably be linked to you as an identifiable individual or to a device that is linked to you.

We may also disclose personal data that we collect or that you provide as described in this Notice:

  • To our subsidiaries and affiliates;
  • To contractors, service providers, and other third parties we use to support our organization;
  • To third-party artificial intelligence, machine learning, and cloud computing service providers that assist us in operating the Playgrounds Applications, training models, or providing AI-related features;
  • To our legal and professional advisors;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Provider’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by Provider is among the assets transferred;
  • To fulfill the purpose for which you provide it;
  • For any other purpose disclosed by us when you provide the information; or
  • With your consent.

We may also disclose your personal data:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request; or
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our organization or others.

The categories of personal data we may disclose include:

  • Contact information;
  • Location information, including general geographic location;
  • Device information; and
  • Content and information you elect to provide to us.

Although we may sell deidentified information, we do not sell your personal information in exchange for monetary or other valuable consideration. To the extent that the automated data collection technologies described in Section 3 are considered a “sale” or “sharing” of personal data for cross-context behavioral advertising under applicable state privacy laws, you may opt out as described in Section 3 and in Section 7.

We require our service providers to agree to contractual terms that limit their use of personal data to the purposes for which it was disclosed to them and that require them to implement reasonable security measures to protect such data.

6. Your Rights and Choices About Your Information

This section describes mechanisms you can use to control certain uses and disclosures of your information and rights you may have under state law, depending on where you live.

Advertising, marketing, cookies, and other tracking technologies choices:

  • Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. You can choose whether or not to allow the Playgrounds Applications to collect information through other tracking technologies by adjusting your “Cookies Preferences” when you first visit each of the Playgrounds Applications or by sending a request to opt out to the contact information below. If you disable or refuse cookies or similar tracking files, some features may be inaccessible or not function properly. Some browsers include a “Do Not Track” (“DNT”) setting that can send a signal to the online Playgrounds Applications you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, the Playgrounds Applications may not respond to all browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described in this Notice.
  • Promotions by Provider. If you do not wish us to use your information to promote our own or third parties’ products or Playgrounds Applications, you can opt out by sending a request to the email address or postal address listed at the bottom of this Notice.

7. Your State Privacy Rights

Depending on your state of residency, you may have certain rights related to your personal data, including:

  • Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible and required by state law, depending on your state, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information, and it will be included in the response to your access request.
  • Correction. You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information’s nature and processing purpose.
  • Deletion. You may request that we delete personal data about you that we maintain, subject to certain exceptions under applicable law.
  • Opt Out of Using Personal Data for Targeted Advertising, Profiling, and Sales. You may request that we do not use your personal data for these purposes.
  • Right Not to Be Discriminated or Retaliated Against. You have the right not to face retaliation or discrimination, including in connection with your candidacy for employment, for exercising other rights related to your personal data.

Important: The exact scope of these rights varies by state. You may not have any of these rights. There are also several exceptions where we may not have any obligation to fulfill your request.

To exercise any of these rights, please send your request to the email address or postal address listed at the bottom of this Notice. To appeal a decision regarding a consumer rights request please send your request to appeal to the email address or postal address listed at the bottom of this Notice.

We may verify your identity before fulfilling any request by asking you to confirm information associated with your account. We will respond to verifiable requests within the timeframes (if any) required by applicable law. We reserve the right to decline requests that are excessive, repetitive, or manifestly unfounded.

8. How We Protect Your Personal Data

We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Playgrounds Applications. Any transmission of personal data is at your own risk.

The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.

9. How We Retain Your Personal Data

We keep the categories of personal data described in this Notice for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as operating, maintaining, and improving the Playgrounds Applications, creating and providing new features or functionalities of the Playgrounds Applications, creating or providing new software, products, or services to you or to others, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal data. At the end of the retention period, personal data will be deleted, destroyed, or deidentified.

10. Text Messages (SMS)

If you choose to connect your mobile number to your assistant in the Playgrounds Applications, we text you a one-time code to confirm the number, and you agree, by ticking the consent box, to receive text messages from Playgrounds at that number: sign-in and verification codes, notifications, and replies from your assistant. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.

What we collect

  • Your mobile number;
  • A record of your consent: when you gave it, the IP address and browser (user agent) you gave it from, the version of the consent wording you agreed to, and, if you later withdraw it, when;
  • The content of the text messages you send to your assistant and of its replies; and
  • Delivery information about those messages, such as the time sent and delivered and the delivery status reported by our provider.

Why we use it

To confirm your number, to send you sign-in and verification codes, to deliver notifications from your assistant, and to carry on the conversation you have with your assistant by text.

Our provider

Text messages are sent and received through Twilio Inc., which processes your mobile number and the messages on our behalf, as our service provider.

How long we keep it

Text messages are kept with your assistant’s other messages and under the same retention as the rest of your assistant’s messages. Consent records are kept for as long as your consent stands and for four (4) years after it ends, to show that we complied with messaging rules.

No sharing for marketing

We do not sell your mobile number or your opt-in data. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

Your choices

Reply STOP to any of our text messages to opt out; we will stop texting that number until you reply START. Reply HELP for help, or email support@myplaygrounds.ai. You can also disconnect your number at any time in your assistant’s settings. Message and data rates may apply; your mobile carrier’s terms apply to the messages you send and receive.

11. Your Assistant’s Connected Mailbox, Web Search, and Downloads

Connected Microsoft mailbox

If you connect a Microsoft mailbox to your assistant, your assistant reads your mail live from Microsoft when it needs to, on your instruction or under the settings you choose. We store the identifiers of the messages it works with and the notes your assistant writes about them (for example, a summary, a priority, or a follow-up). We do not keep copies of your mail bodies at rest. You can disconnect the mailbox at any time, after which your assistant can no longer read it.

Web search and downloads

When you ask your assistant to search the web or to open or download a page or file, it fetches that content from the public internet on your instruction. Search queries are sent to our artificial intelligence service providers’ search features to carry out the search. Files your assistant downloads for you are saved to your Files in the Playgrounds Applications, marked with where they came from, and you can delete them there.

12. Changes to Our Privacy Notice

We may update this Notice from time to time, and we will provide notice of any material changes to the Notice as required by law. The date the Notice was last updated is identified at the top of the page. We will notify you of material changes to this Notice by updating the “Last Updated” date and posting the updated Notice on the Playgrounds Applications. We may email or otherwise communicate reminders about this Notice, but you should check our Playgrounds Applications periodically to see the current Notice and any changes we have made to it.
